Journée des Droits de l'Homme - J'accuse Lettre ouverte à Ban Ki Moon - version française et anglaise.
Publiée à l'occasion de la Journée des Droits de l'Homme, célébrée chaque année le 10 Décembre, cette lettre, dans le contexte de mépris auquel est confronté Israël, se veut avant tout un réquisitoire pour le rétablissement de la vérité et de la justice. Israël, le «capitaine Dreyfus» du Moyen-Orient et du monde, ne cesse d'être le bouc-émissaire de tous les maux et, de victime, est devenu pour la majorité des Nations, le bourreau. Nous ne pouvons accepter qu'un tel état de fait puisse perdurer.
Le droit moral et historique de six millions de Juifs de vivre en Erets-Israël n'a de cesse d'être outragé par l'Organisation des Nations-Unies. Cette lettre est donc un appel à la conscience humaine afin qu'Israël soit rétabli dans sa dignité de peuple pacifique parmi les Nations.

Published on the occasion of the Human Rights Day, that occurs on 12-10, this letter, in the context of contempt faced by Israel, is above all
an indictment in view of the restoration of truth and justice. Israel, the «Captain Dreyfus» in the Middle East and the whole world, continues to be the scapegoat for all ills. Whereas Israel was previously a victim, he has become for the majority of Nations, the executioner. We cannot accept this state of affairs to continue.
The moral and historical right of six million Jews to live in Erets-Israel keeps with being flouted by the United Nations Organization. This letter is therefore an appeal to the human conscience in order to re-establish Israel in its dignity of a non-violent people among the Nations.

Mr. Ban Ki-Moon, Secretary-General of the United Nations,
Allow me, in consideration of the unique and supreme responsibility that falls to your lot as to the establishment and maintenance of universal peace, to urge you not to spare your efforts in order to fulfill the mission of the United Nations Organization to encourage «respect for human rights and for fundamental freedoms for all without distinction as to race, sex, language, or religion» (Art. 1 UN Charter). The Jewish people does not forget the role of the United Nations at the time of the vote in favor of a Jewish state alongside an Arab state on November 29, 1947 and on the occasion of the integration of the newborn Israel in its midst on May 11, 1949. Now, anti-Zionism and anti-Semitism have grown since then, that bring to mind the onset of last century, blaming indiscriminately the Jewish state and its Jewish citizens. Israel, the new-found «Dreyfus» of the world, require justice to evermore abolish and banish this cancer that eats away your esteemed institution.
I accuse the pleadings of the Goldstone report, to endorse in a totally biased way the terrorist movement Hamas and to denounce Israel as the main cause of the outbreak of «Operation Cast Lead», which brings discredit and shame on the Organization of the United Nations. How do you dare endorsing the Hamas movement, although it kidnapped an Israeli soldier, Gil'ad Shallit, since 1629 full days, and from that time, he lives devoid of basic human rights (Red Cross visits among other things)? How don't you condemn it firmly and ban it for trampling so roughly on UN's human rights? How Israel, the «ember from the fire» people, (Zech. 3, 2) that seeks for peace, ends up once again on the dock, whereas Hamas missiles (over 530 in total) which indeed made few casualties, kept up for three consecutive weeks, falling down on Sderot, Ashkelon, Ashdod and Beer Sheva, carrying with them death and destruction?
I accuse this report that will remain as a stain in the United Nations' history. The natural law of self defense is recognized for every nation by virtue of the United Nations' Charter (Art. 51, Chapt. 7). However, a study based on the principles of neutrality and impartiality should have proved the advisability of the Israel's right to counteract the offense of the terrorist group Hamas and his peers (Islamic Jihad, Al Aqsa Martyrs' Brigades, etc…) that kept up with attacking Israel simultaneously with the second Intifada (which began in September 2000), until the beginning of the «Operation Cast Lead», contradicting in that way the grand principles of the United Nations' founders, and breaking the few confidence that we had towards the United Nations Organization, whose conciliatory role was once again violated.
I accuse that machination to be consecrated to delegitimize and demonize Israel. Your assent's extreme precipitation to this infamous report's false conclusions, without the critical spirit that behoves you as Secretary-General of the United Nations cannot remain indifferent to our people of Israel that longs since the mists of time for the eradication of injustice and for building a world full of justice where fundamental human rights appropriated to all men would be finally respected. Our people, faithful to the principle of respect for life of Man created in the image of God, keeps up, through the State of Israel, with the achievement of the dual promise, that of the open education to everyone without segregation and that of the prophet Isaiah (2, 4): «They will beat their swords into plowshares
and their spears into pruning hooks. Nation will not take up sword against nation,
nor will they train for war anymore». As a proof, the adoption by the General Assembly in 2007 of the Israeli's initiative of aid to poor countries where drought and hunger wreak havoc as part of the ambitious UN «Millennium Development Goals», almost unanimously (118 votes with 29 abstentions, none against) – a once-in-a-time event in the annals of the UN. The aim of the Israeli proposal is, through the technological development in agriculture, to reduce hunger by 2015. The universality of our mission must therefore attract your attention. Zionism, now the United Nations' favorite target, has always wanted, beyond its aspiration to liberate the people of Israel from the millennium-old humiliation which he suffered, to be a light for all human-beings living in this planet, by fulfilling by its acts of aid to nations of the world, without distinction, the abrahamic blessing that you ought to know: «and all peoples on earth will be blessed through you» (Genesis, 12, 3). I remind you the main part of Israel in this field, whether in Haiti after the 1-12-2010 earthquake; in Turquey at the time of the 1999 earthquake, on the urging appeal of the Turkish Foreign Minister Ahmet Oguelu; in Thailand at the time of the landing plane crash at Phuket on 9-16-2007 – Israel was lavish on his assistance to all countries that wished so, including Iran, on the express request of its ambassador; to Thailand, Sri Lanka and Indonesia during the devastating 12-26-2004 tsunami; or elsewhere, not to mention the aid discreetly granted to populations of countries having no diplomatic relations with Israel, considering only the human suffering wherever it is.
I accuse your words: «The United Nations will continue to support international efforts aimed at bringing an end to the occupation that began forty years ago, and achieving a two-state solution» (Pretoria 5-9-2007) to be a historical falsification. To what occupation do you hint? These territories, annexed by the Jordanian forces (1948) without any opposition from the UN, came under Israeli control consecutively to the armed attack of Arab countries, returning to their true historic owners, in accordance with the decisions of the San Remo Conference (1920) that have not lost their legal force in the international field, since they were not repealed in plenary session.
I accuse the United Nations Organization to celebrate every year on November 29 (the partition plan for Palestine's anniversary) the «International Day of Solidarity with the Palestinian people», as decided by the UN General Assembly of 12-2-1977 (resolution 32/40 B), of 12-12-1979 (resolution 34/65 D), without forgetting its later resolutions on the question of Palestine. This date was chosen «because of its meaning and significance to the Palestinian people», for the reason that «Of the two States to be created under this resolution, only one, Israel, has so far come into being». This Memorial Day is willing to attract the attention of the international community to the fact that «the question of Palestine remained unresolved and that the Palestinian people are yet to attain their inalienable rights as defined by the General Assembly, namely, the right to self-determination without external interference, the right to national independence and sovereignty, and the right to return to their homes and property from which they had been displaced». Consequently, this celebration disregards the only reason why the Arab state which had to be born alongside the Israeli state has not yet emerged, sixty-three years after the UN decision, which is the repeated and constant refusal of Arab nations and first, the Palestinians, to recognize a non-Arab state in the region. Was this rejectionist front ever denounced by your esteemed institution? Has the UN ever set a similar solidarity day with the Jewish people in Israel, bowed from the first moment that followed the decision of 11-29-1947, to repeated and constant attacks, to whom succeeded the attack of five Arab states, within the first hour following the British departure, on 5-15-1948? Has it ever bothered to organize, under its aegis, parallel conferences and debates explaining Israel's position?
I accuse the United Nations of failing in its historic mission, that one which dreamed Eleanor Roosevelt and René Cassin, the emblematic drafter of the «Universal Declaration of Human Rights» who, besides their support for the Zionist cause, would have not, without a shadow of a doubt, endorsed this harmful deviation, making inroads each day a little more into the peace mission of yours, to whom worked its founders without failing.
I accuse your Organization's benevolence and dumbness, to be abetters of terrorism and Arab Palestinian revisionism. How Abou Mazen, author of a doctoral thesis ascertaining the links between Zionism and Nazism from 1933 to 1945, enjoys a legitimate representation called «Palestine» in the United Nations and a free pass, whereas he, Abou Mazen, non content with disclaiming the Jewish character of Israel, on top of that, struggles hard to deny its existence?
I accuse the unconditional support you have shown for the cause of the Palestinian Authority, whose anti-Zionist and anti-Semitic charter, adopted in 1964, thus even before the Judea and Samaria territories' problem is raised, and amended in 1968, after the Six-Day War, declares the partition of Palestine in 1947 and the establishment of the State of Israel «null and void» (Article 19); the goal of Palestine's liberation, which is to «purify» the country from any Zionist presence (Article 15); Jews as being «neither a people nor a nation» (Article 20)... Since there was to date no new charter approved and voted by the Palestinian parliament on the proposals amended by Yasser Arafat, the original charter of 1968 is still in force. Now, it pleads for the establishment of a Palestinian state which would be in favor of the idea of a «Judenrein» state, i. e. ethnically pure from Jews (Article 15). How the very noble United Nations Organization, which admitted the idea of a Jewish state alongside an Arab state (Partition Plan for Palestine - Resolution 181), combines its support for an entity leaning on theories in force during the Shoah («ethnic cleansing», Article 15), with the historical event of 1-27-2005 (special session of the Security Council to commemorate the sixtieth anniversary of the liberation of death camps)? This council was followed each year by the International Day of Commemoration in memory of Holocaust victims. Didn't you say that «Holocaust Survivors will not be with us forever ‑‑ but the legacy of their survival must live on»? How the United Nations combines his support for this entity that denies the very existence of the Jewish people as a nation («Jews are neither a people nor a nation», article 15), whereas the former Secretary General of the United Nations, Kofi Annan, decreed in the «IPR seminar on anti-Semitism» (6-21-2004): «The rise of anti-Semitism anywhere is a threat to people everywhere. Thus, in fighting anti-Semitism, we fight for the future of all humanity»?
I accuse the United Nations to participate in the de-legitimization of the State of Israel and, thus, to be guilty of violating human rights (whereas the state of Israel is the only democratic state respecting human rights in the region, the number of charges against him far exceeds those brought against states that publicly flout those rights) and to have repeatedly invited Iran's President Ahmadinejad not only in its chamber (19-9-2006, 23-9-2010) but also in Geneva, at the Durban II conference on 20-4-2009, where he was received with the full honors paid to a great statesman. How do you combine these «visits» with the Charter of the United Nations («We, the peoples of the United Nations determined to reaffirm faith in fundamental human rights, in the dignity and worth of the human person, in the equal rights of men and women and of nations large and small...» (Preamble), «All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations» (Article 2)?
I accuse the United Nations to show indifference, benevolence and complicity with respect to Arab nations, signatories of the Arab Charter on Human Rights (2004) (negotiated under the aegis of the Arab League and ratified in January 2008) as Algeria, Saudi Arabia, Tunisia, Yemen, including Egypt, which, sitting in the midst of the world's highest organization, make a point of joining the idea that was actually deemed bygone, that «…racism and Zionism… constitute a violation of human rights and a threat to international peace and security...» (Preamble). The United Nations' indifference, their benevolence, their complicity towards Arab nations signatories of the Arab Charter of Human Rights are equally outrageous towards African nations that on behalf of freedom and dignity «undertake to eliminate Zionism» as well as «colonialism, neocolonialism, apartheid» (Preamble to the African Charter on Human and Peoples). What connection can there be between Zionism, a return movement of the Jewish people to its homeland, with colonialism in all its forms, when people just despoil other peoples' land? The very word «Jew», whose meaning is «Judean», does leave a mark of its belonging to the ancient land of Judea. The word «Israeli» does confirm all the love of the Israeli people to their land. Now how can anti-Zionist or even anti-Semitic nations sit at the United Nations, the highest global institution, but also practise their right to vote against Israel? This deplorable fact is, I think, in total contradiction with the United Nations' founders' intention, while Resolution 1339 abolished Resolution 1995, equating Zionism with racism. History will judge your willingness to ban these two racist and anti-Semitic charters, with this assimilation between Zionism and Apartheid in a state where minority rights are respected. I can only remind you, as a citizen of Israel, that this principle of love, respect and dignity of the Other is inscribed in the very heart of the State of Israel's Declaration of Independence: «it (the state of Israel) will ensure complete equality of social and political rights to all its inhabitants irrespective of religion, race or sex; it will guarantee freedom of religion, conscience, language, education and culture; it will safeguard the Holy Places of all religions; and it will be faithful to the principles of the Charter of the United Nations».
I accuse the United Nations to try to perpetuate the Palestinian refugee problem. Whereas all the world's refugees come under the authority of the United Nations High Commissioner for Refugees (UNHCR), showing a significant success, UNRWA-supported Palestinian refugees enjoy a special status, advantaging the perpetuation process of the refugee camps and converting their rehabilitation in an outsider country, in an insoluble problem.
I accuse the United Nations to see Jerusalem only as an occupied colony but not as the unified and indivisible capital city, and an integral part of the Jewish state. Can 3000 years of Jewish presence in Jerusalem be annihilated? Jerusalem was the capital city of King David, the magnificent Psalms' author, the one of King Solomon, known for his proverbial wisdom, and many other kings after them, when Jerusalem was the Judea kingdom's capital city. How long did Jerusalem belong to any «Palestinian state»? The term «Syria-Palestine» was only enforced by the Roman invaders after the Temple's destruction in AD 70, meaning that the Judea and Israel kingdoms' territory lost its independence and became a Roman province of Palestine; Palestine as it stands has never been an independent state and Jerusalem never was the capital city of any other kingdom than the David and Solomon's and the Judea and Israel kingdoms, nor of any other state than the modern state of Israel. While under the Mandatory government, laws strictly regulated the presence of Jews at the Western Wall, their most sacred place of worship; while, under Jordan government, East Jerusalem was off limits not only to Israelis but also to Jews around the world, for the first time since the liberation of eastern Jerusalem, the disciples of all religions, including the three major monotheistic religions, have free access to their respective places of worship, whereas full liberty of conscience is guaranteed by the Israeli government. How do you combine the contradiction between the Jerusalem City's status appointed by Resolution 181 calling for the establishment of a special international regime as a corpus separatum, Jerusalem being administered by the United Nations, and the terms of the General Assembly Resolution 64/185 (12-21-2009): «Stressing the need for respect and preservation of the territorial unity, contiguity and integrity of all of the Occupied Palestinian Territory, including East Jerusalem»?
However, I would not deceive anyone about the intentions expressed in this letter. I by no means don't lay claim to officially represent the Jewish people, but I think I can say that the thirst for justice and equity enshrined in the Jewish people's ancient tradition leads us to believe that the United Nations is a foremost institution whose original intentions of democratization and freedom have been hijacked by many Arab and Muslim nations whose spirit of belligerence, more alive than ever, leaves no doubt about the abhorrent and revolting hatred that you echo, betraying the wonderful message of hope whose prophets were Eleanor Roosevelt and René Cassin.
We fear less the Nations' indictment than hypocrisy and lies, the worst enemies of democracy.
Mr. Secretary-General of the United Nations, I invite you to meditate on the Israel history, like the phoenix rising from its ashes,on the fraternal vision that leads our small state, the living embodiment of the Biblical prophets' spirit and on the sincere aspiration of its citizens to peace: «We extend our hand to all neighboring states and their peoples in an offer of peace and good neighborliness, and appeal to them to establish bonds of cooperation and mutual help with the sovereign Jewish people settled in its own land. The State of Israel is prepared to do its share in a common effort for the advancement of the entire Middle East». (Israeli Declaration of Independence).
Please accept, Mr. Secretary-General of the United Nations, the assurances of my highest consideration.
